INFORMATION AND CONSENT
for the processing of special, including genetic, personal data
for the purpose of organizing a specific genetic study

A. INFORMATION PROVIDED BEFORE OBTAINING CONSENT

2. Purpose of Personal Data Processing

Organization of the genetic study selected by the personal data subject to be performed by a specialized laboratory, including:

• identification of the specific order, study participant, and sample provided by the participant;
• organization of the delivery of a biological sample independently obtained by the participant to a specialized laboratory;
• transfer to the laboratory of personal data objectively necessary to perform the selected study;
• performance of the genetic study by the laboratory and generation of the result;
• receipt by LLC “DNA Test Center” of the completed result from the laboratory and its transfer to the Customer in accordance with the agreement and applicable law.

3. List of Personal Data Processed

Within the scope of the stated purpose, only data necessary for the specific type of study may be processed:

• surname, given name, patronymic (if applicable) — if such information is necessary for the specific order/result;
• date of birth and sex — if they are necessary for the specific type of study;
• information about the participant’s role in the study (for example: alleged father, mother, child, other participant);
• order number/identifier and biological sample code;
• type of genetic study ordered;
• information contained in the biological sample and obtained during the laboratory study, including genetic personal data;
• genetic profile and other special personal data generated by the laboratory during the study;
• information contained in the result of the genetic study.

The Customer’s contact, payment, and other ordinary personal data necessary for entering into and performing the agreement are processed on an appropriate independent legal basis and are not included in this consent merely because they are related to the order.

4. Actions with Personal Data

For the stated purpose, LLC “DNA Test Center” may collect, record, systematize, store, update, use, provide (transfer) data to the laboratory, receive the result from the laboratory, transfer the result to the Customer, block, delete, and destroy personal data. Processing may be carried out using automated means or without their use.

5. Laboratory and Cross-Border Transfer

The genetic study itself is performed by Limited Liability Company “Inlab Genetics” (LLC “Inlab Genetics”), INN 7838102187, OGRN 1227800017851, legal address: 190005, Russian Federation, St. Petersburg, 18 Izmailovsky Ave., Building D, Premises 28-N.

For the performance of the selected study, LLC “DNA Test Center” transfers to LLC “Inlab Genetics” only the data necessary for the specific study, as well as the biological sample independently obtained by the participant and provided for the study.

The transfer of personal data to the Russian Federation constitutes a cross-border transfer. This information notice and consent cover such transfer exclusively within the scope of the purpose specified in Section 2 and to the extent necessary to perform the selected study.

6. Period for Which Consent Is Given

The above period applies to special/genetic personal data and the study result. Personal data contained in contractual, settlement, accounting, and other documents may be retained for a longer period only if there is an independent legal basis and for the periods established by applicable law.

7. Consequences of Refusal to Give Consent

If the processing of the specified special/genetic personal data is objectively necessary to organize the selected genetic study and there is no other applicable legal basis, then if this consent is refused, LLC “DNA Test Center” will not be able to organize the performance of such study or the transfer of the relevant data to the laboratory.

8. Rights of the Personal Data Subject

The personal data subject has the right, in the cases and in the manner provided for by the Law of the Republic of Belarus dated May 7, 2021 No. 99-Z “On the Protection of Personal Data”, in particular:

• to receive information concerning the processing of their personal data;
• to request amendments to personal data where the grounds provided by law exist;
• to receive information about the provision of personal data to third parties in cases provided by law;
• to withdraw consent to the processing of personal data;
• to request termination of the processing of personal data and/or their deletion where the grounds provided by law exist;
• to challenge the actions (inaction) and decisions of the Controller in accordance with the procedure established by law.

9. Procedure for Withdrawal of Consent

Withdrawal of consent may be sent to LLC “DNA Test Center” in accordance with the procedure established by law and the Personal Data Processing Policy, to the Controller’s legal address or by another permissible method provided for by the applicable Policy.

Upon receipt of the withdrawal, processing carried out exclusively on the basis of this consent shall be terminated in accordance with the procedure and within the time limits established by law, unless there is another legal basis for continuing such processing. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal was received.

FREELY, UNEQUIVOCALLY AND INFORMEDLY GIVE MY CONSENT to LLC “DNA Test Center” to process my personal data listed in Section A, including special and genetic personal data, exclusively for one purpose — organizing the performance of the above-mentioned genetic study — for the period specified in Section A and with the performance of the actions listed therein.

For the stated purpose, I also consent to the provision (transfer) of my special, including genetic, personal data necessary for the selected study to LLC “Inlab Genetics”, Russian Federation, for the direct performance of the study, generation of the result, and transfer of the result to LLC “DNA Test Center” for subsequent transfer to the Customer.

I understand that this consent does not constitute consent to advertising, marketing mailings, publication of reviews, use of data in advertising materials, optional analytics, or other separate purposes.

A separate consent form shall be completed for each adult participant with legal capacity if consent itself is the legal basis for processing their data. For a minor or another person whose interests are represented by a legal representative, the document shall be completed by a person possessing the relevant authority, with the basis for representation specified.
